Important: Contract Formation
By placing a listing with us, you are deemed to have accepted these Listing Terms & Conditions. A separate contract is formed for each listing you create on Cyclesite.
These terms apply to BOTH private sellers and trade sellers (dealers/retailers).
1. Definitions
- "Platform" means the Cyclesite website, mobile applications, and associated services
- "Listing" means an advertisement for a bicycle or related item submitted by you
- "Private Seller" means an individual selling personal items not in the course of business
- "Trade Seller" means a business, dealer, or retailer selling in the course of trade
- "BikeCheck" means our stolen bicycle verification service
- "Frame Number" means the unique serial number stamped on the bicycle frame
2. Account Registration & Responsibilities
To create listings, you must register an account. You agree to:
- Provide accurate, complete, and truthful registration information
- Keep your login credentials secure and confidential
- Not use offensive, misleading, or impersonating usernames
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
Cyclesite disclaims liability for unauthorized access to your account unless caused by our negligence.
3. Listing Eligibility
3.1 Eligible Items
- Complete bicycles (road, mountain, hybrid, electric, BMX, etc.)
- Bicycle frames and forks
- Bicycle components and parts
- Cycling accessories and equipment
- E-bikes with valid battery and motor documentation
3.2 Stolen Bike Verification
All listings are automatically checked against UK stolen-bike databases. Bicycles reported as stolen cannot be listed.
3.3 Frame Number Requirements
- All complete bicycles and frames must have a visible frame number
- You must provide the frame number during listing creation
- Bicycles without frame numbers require additional verification
- Listings with invalid or removed frame numbers may be rejected
4. Prohibited Content & Conduct
You must not submit listings that contain:
- Stolen bicycles or items without proof of ownership
- Counterfeit, replica, or fake branded products
- Material infringing third-party intellectual property rights
- Defamatory, obscene, profane, or discriminatory content
- Personal information of third parties without consent
- Content promoting unlawful activity or terrorism
- Spam, unauthorized commercial links, or irrelevant materials
- Non-English text (except brand names)
- False, misleading, or deceptive information
- Multiple duplicate listings for the same item
Violations may result in listing removal, account suspension, and reporting to law enforcement where appropriate.
5. Seller Warranties
By creating a listing, you warrant and represent that:
- You are a UK resident aged 18 or over
- You have legal ownership or authority to sell the item
- The item is not subject to any outstanding finance or security interest
- All information provided is accurate, complete, and not misleading
- Photos genuinely represent the actual item being sold
- The listed price is genuine and you intend to sell at that price
- You will not engage in fraudulent or deceptive practices
- You will comply with all applicable laws and regulations
5.1 E-Bike Specific Warranties
For electric bicycles, you additionally warrant that:
- The motor power does not exceed 250W continuous rated power
- The pedal-assist cuts off at 15.5mph (25km/h) for EAPC compliance
- Battery condition and cycle count are accurately disclosed
- The e-bike complies with UK EAPC regulations (or is disclosed as non-compliant)
5A. Electric Bicycle (E-Bike) Safety Requirements
Critical Safety Notice: Lithium-Ion Battery Fire Risk
E-bike batteries can pose serious fire risks if damaged, improperly charged, or of poor quality. Sellers must ensure all safety disclosures are made accurately. Battery fires can cause serious injury, death, and property damage.
5A.1 UK Legal Classification (EAPC Regulations)
For an e-bike to be legally ridden without registration, insurance, or a licence in the UK, it must meet ALL of the following (Electrically Assisted Pedal Cycles Regulations 1983, as amended):
- Maximum continuous motor power: 250 watts
- Power cut-off speed: 15.5 mph (25 km/h)
- Pedal-assist only: Motor must not operate without pedalling (throttle-only modes not permitted on new e-bikes since 2016)
- Rider age: Must be 14 or over to ride on public roads
Non-Compliant E-Bikes
E-bikes exceeding 250W or 15.5mph are classified as motor vehicles requiring registration, insurance, MOT, and appropriate licence. You MUST clearly disclose if an e-bike is non-EAPC compliant. Failure to disclose is a material misrepresentation.
5A.2 Battery Safety Disclosures (Mandatory)
All e-bike listings MUST include the following battery information:

5A.3 Prohibited Battery Conditions
You must NOT list e-bikes with batteries that:
- Are visibly swollen, bulging, or deformed - Immediate fire risk
- Have physical damage - Cracks, punctures, dents to cells
- Show signs of water damage or corrosion
- Emit unusual odours - Sweet, chemical, or burning smells
- Have exposed wiring or damaged connectors
- Are of unknown origin - No-brand "grey market" cells with no CE/UKCA marking
- Have been modified or rebuilt - Unless by a certified professional with documentation
Listing a bike with a dangerous battery is a violation of Product Regulation and Metrology Act 2025 marketplace duties.
5A.4 Shipping & Transport Restrictions
Lithium-ion batteries are classified as Dangerous Goods (Class 9) under IATA/ADR regulations:
- Royal Mail: Batteries over 100Wh prohibited; under 100Wh requires special packaging
- Couriers: Many refuse lithium batteries; check carrier terms before promising delivery
- Collection recommended: In-person collection is the safest transfer method
- Seller responsibility: You are liable for compliant packaging if shipping
Safe Collection Tip: When collecting an e-bike, ask the seller to demonstrate charging and ride the bike before completing the transaction. Test the battery connection and verify the charger works.
5A.5 Fire Safety Guidance for Buyers
We strongly recommend all e-bike buyers:
- Charge in a well-ventilated area, away from flammable materials
- Never leave charging unattended or overnight
- Use only the manufacturer-approved charger
- Do not charge immediately after riding (let battery cool)
- Store batteries between 20-80% charge if not using for extended periods
- Consider a fireproof charging bag for added safety
- Have a working smoke alarm in the charging area
5A.6 Cyclesite E-Bike Liability Disclaimer
Cyclesite provides an advertising platform only. We do not:
- Inspect, test, or certify e-bikes or their batteries
- Guarantee EAPC compliance or battery safety
- Accept liability for fire, injury, or damage caused by e-bikes or batteries
- Warrant the accuracy of seller-provided battery information
Buyers must conduct their own due diligence. For high-value purchases, consider a professional inspection by a qualified e-bike technician.
6. Private vs Trade Seller Requirements
6.1 Private Sellers
If you are selling personal items not in the course of business:
- You may list items you personally own
- You must not sell more than 5 bicycles per calendar year (indicative threshold)
- Regular high-volume selling may indicate trade activity
6.2 Trade Sellers (Dealers & Retailers)
If you sell in the course of business, you must:
- Register as a trade seller on your account
- Display your business name, address, and registration details
- Comply with the Consumer Rights Act 2015
- Comply with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
- Provide statutory warranty information
- Not pose as a private seller (violation of Consumer Protection from Unfair Trading Regulations 2008)
Warning: Trade sellers masquerading as private sellers face listing removal without refund, account termination, and potential legal action under Consumer Protection regulations.
7. Platform Rights
Cyclesite reserves the right to:
- Refuse, edit, or delete any listing at our discretion
- Reclassify listings into appropriate categories
- Correct typographical errors or technical issues
- Remove listings that violate these terms or applicable law
- Suspend or terminate accounts for breach of these terms
- Cooperate with law enforcement investigations
We aim to process listings within 24 hours, but this is a target only and not guaranteed.
8. Intellectual Property
8.1 Your Content
By submitting a listing, you grant Cyclesite a non-exclusive, irrevocable, perpetual, worldwide, royalty-free licence to:
- Display, reproduce, and distribute your listing content
- Use your photos and descriptions across our platforms
- Share listings with partner sites and marketing channels
- Modify content for formatting and display purposes
8.2 Our Content
All content created or modified by Cyclesite, including designs, logos, and platform features, remains our exclusive property. You may not copy, reproduce, or use our intellectual property without written permission.
9. Publication & Display
Your listing may appear across:
- Cyclesite website (desktop, mobile, tablet)
- Our mobile applications
- Partner websites and aggregators
- Social media platforms and advertising channels
- Search engine results
By submitting a listing, you acknowledge that your listing (including photos and contact information) may be viewable worldwide by anyone with internet access.
10. Fees & Payment
10.1 Current Pricing
Private seller listings are charged on a tiered basis. The exact fee for your listing is shown to you before you publish it during the listing flow, which is the authoritative source in the event of any difference from the summary below. At the time of writing:
- Basic: from £10.99 per listing (30 days)
- Standard: higher tier with extended duration and enhanced visibility (see pricing page for current rate)
- Premium: top tier with homepage placement and featured badge (see pricing page for current rate)
10.2 Payment Terms
- All paid packages require pre-payment before activation
- Prices are as displayed at the point of purchase
- Payment is processed via secure SSL connection
- We accept major credit and debit cards (UK-registered)
10.3 Transparent Pricing Model
Cyclesite operates on a transparent listing fee model, starting from £10.99 tiered by asking price. For private classified sales where the buyer and seller transact directly (for example, collection in person), the listing fee is the total platform cost to the seller. For sales completed through optional Buyer Protection with secure delivery, a transparent transaction fee applies to cover payment processing, the inspection window and dispute resolution, this fee is shown to both buyer and seller at checkout before either party commits. Auction listings may be subject to additional fees as specified in the auction terms.
10a. Saved payment method for Buyer Protection listings
10a.1 Requirement
In order to list a bike with Buyer Protection (“escrow”) enabled, you must save a valid UK-issued debit or credit card (the “Card”) with our payment processor, Stripe Payments UK Limited (“Stripe”). The Card is stored by Stripe pursuant to its own terms of service; Cyclesite does not store the full Card number on its systems and holds only the tokenised reference supplied by Stripe. Where you do not maintain a valid Card on file, you may continue to list bikes without Buyer Protection, but Buyer Protection listings will be suspended until a valid Card is on file.
10a.2 Authority to charge (mandate)
By saving the Card, you authorise Cyclesite to charge the Card without requiring further authentication from you at the time of charge (an “off-session charge”) for the following specific amounts and in the following specific circumstances only:
- the unrecoverable payment processing fee retained by Stripe on any refund issued to a buyer where a dispute is resolved against you (typically 1.5% of the original charge plus 20 pence for UK-issued cards, higher rates applying to non-UK cards);
- any chargeback fee imposed by Stripe (at the time of writing, £15 per chargeback) where a buyer raises a chargeback in respect of one of your sales and the chargeback is not successfully defended;
- any administration fee expressly disclosed in the Refund Policy, being a fee reasonable in amount to cover Cyclesite's actual costs of investigating and administering the dispute.
Cyclesite will not charge the Card for any amount not falling within clauses 10a.2(a)–(c).
10a.3 Notice of charge
Save where the charge is immediate and of an amount less than £30, Cyclesite will use reasonable endeavours to notify you by email not less than 48 hours before the Card is charged. Each notification will set out the amount, the reason for the charge and a link to the sale transaction to which it relates. You may contest a proposed charge by replying to that notification before it is made.
10a.4 Right to contest a charge
If you disagree with a charge after it has been made, you may contest it by emailing support@cyclesite.co.uk within 14 days. Cyclesite will respond within 10 working days and, where the charge is found to have been made in error, will refund it in full. Nothing in this clause removes your statutory right to dispute a payment with your card issuer.
10a.5 Card management and removal
You may view your saved Card in your seller dashboard and replace it with another valid Card at any time. You may not remove the Card (without replacement) while:
- you have any active escrow transaction on one of your listings; or
- you have any outstanding amount owed to Cyclesite under clause 10a.2.
10a.6 If the Card cannot be charged
If a charge against the Card fails (for example because the Card has expired, been declined, or the available balance is insufficient):
- Cyclesite will attempt the charge again after 24 hours and, if that attempt also fails, after a further 7 days;
- if all attempts fail, Cyclesite may withhold the amount owed from your next successful payout from any sale on Cyclesite, by way of set-off; and
- in no circumstances will Cyclesite redirect the amount owed to the buyer on the transaction concerned. The buyer will receive their refund in full notwithstanding any charge failure on the Card.
10a.7 Card expiry and automatic updates
Stripe's card-updater service may automatically update your saved Card where your issuing bank provides new details. Where your Card expires and is not replaced, your active Buyer Protection listings will be suspended until a valid Card is on file. Existing escrow transactions already in progress are unaffected.
10a.8 Variation of fees
The amounts referenced in clause 10a.2 reflect the fees applicable at the date of these Listing Terms. Where Stripe or a card network changes the applicable fee, the amount charged under clause 10a.2 will reflect the actual cost incurred by Cyclesite and will not be increased beyond that actual cost without your consent. Any material change to the categories of charge in clauses 10a.2(a)–(c) will be notified to you in advance in accordance with Cyclesite’s general change-of-terms procedure.
11. Cancellation & Refunds
11.1 Consumer Contracts Regulations 2013
For paid listings, you have 14 days from purchase to cancel and receive a full refund, UNLESS:
- You requested immediate activation of the listing
- The listing has already gone live on the platform
11.2 Post-Publication
Once your listing is live, you lose the right to cancel and no refund will be provided. You may still remove or edit your listing at any time.
11.3 How to Cancel
To cancel a paid listing package before activation, email support@cyclesite.co.uk. Refunds are processed within 14 days of valid cancellation.
12. Termination
Cyclesite may immediately suspend or terminate your account and listings for:
- Breach of these Listing Terms
- Providing false or misleading information
- Suspected fraud or illegal activity
- Listing stolen or prohibited items
- Trade sellers posing as private sellers
- Abusive conduct towards other users or staff
- Law enforcement or regulatory directives
- Multiple policy violations
Termination for breach does not entitle you to any refund of fees paid.
13. Liability Limitations
Cyclesite is a marketplace platform. We:
- Do NOT directly hold, receive, or control buyer or seller funds (all payment processing and fund custody is provided by Stripe Payments UK Ltd, FCA ref: 900461)
- Do NOT provide financing or insurance
- Do NOT take possession of, store, or deliver items
- Are NOT party to any sale contracts between buyers and sellers
13.1 Exclusions
Cyclesite disclaims liability for:
- Message delivery failures through our platform
- Accuracy of BikeCheck or stolen database information
- Third-party data accuracy
- Completion or outcome of any sale
- Buyer inquiries or lack thereof
- Technical failures from external attacks or force majeure
- Indirect, consequential, or unforeseeable damages
13.2 Exceptions
Nothing in these terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any matter which cannot be excluded by law
14. Data Protection
By submitting a listing, you acknowledge and agree that:
- Your listing information will be viewable worldwide
- Your personal data will be processed in accordance with our Privacy Policy
- Our secure messaging system will be used for buyer-seller communication (email addresses protected)
- Phone number protection via our Protect My Number service may be used (where available)

15. Governing Law
These Listing Terms are governed by English law. The courts of England and Wales have non-exclusive jurisdiction over any disputes.
If you reside in Scotland or Northern Ireland, you may bring proceedings in your local courts, but English law will still apply.
